Should You Choose Spousal Support or Not?
The court will often require the payment of permanent spousal support in cases involving long-term marriages or when one spouse is incapable of supporting herself or himself. The court will make its spousal support calculations based on how long the couple were married, their community assets, the education and earning power of the parties and other factors. The IRS considers spousal support to be taxable income for the receiver and fully tax deductible for the payer. For many people, it makes sense to choose a particular property division settlement that does not involve the payment of spousal support. There are situations though, when you might want to include spousal support in a divorce settlement agreement.
